COMMUNICATION SITUATION COVID 19 In accordance with the Government's recommendations, we are sorry to communicate that, due to the restrictions derived from the measures taken to combat the COVID-19 virus, QSTAR cannot guarantee that there will be no changes other than the dates established in the 2020/2021 course calendar. These courses may be postponed to other dates for reasons of cancellation of attendees to the scheduled course or other reasons derived from the Pandemic. In case of having to postpone the dates of a scheduled course for the above mentioned reasons, alternative dates will be proposed to the student for the completion of the course up to a period of 2 years.

 

QSTAR is not responsible for cancellations of flights, hotel reservations that may have been generated or other expenses of the student and canot be claimed to QSTAR.

Given the exceptionality of the current moment due to the affectation of Covid 19, in cases in which students cannot attend a training course due to infection or to remain in quarantine during this period; An alternative date will be proposed as long as it has been notified with a minimum notice before the course, and proving (before or after) a certificate or medical leave to rovtraining@qstar.es where the condition described above is indicated.

 

PRIVACY POLICY

In accordance with the provisions of Organic Law 15/1999, on Personal Data Protection (hereinafter, LOPD), as well as its implementing regulations, approved by Royal Decree 1720/2007, dated 21 December (hereinafter, RLOPD) and Regulations 2016/679 of the European Parliament and of the Council, dated 27 April 2016 on the protection of physical persons with regards to the processing of personal data and the free circulation of said data (hereinafter, RGPD), QSTAR SLU (QSTAR) informs Users of its Data Protection Policy, so that these may freely and voluntarily determine whether or not they wish to provide the personal data which may be required for subscription or registration purposes as regards some of the Services offered. With the exception of those fields that indicate otherwise, answers to questions on personal data are voluntary.

QSTAR reserves the right to modify this policy to adapt it to changes in legislation or legal or judicial requirements, as well as the practices of the industry, at all times taking into consideration the legitimate interests of the consumer or user. Certain services offered in the Portal may contain their own Specific Conditions with specific stipulations regarding personal data protection.
 
Confidentiality in the automated processing of Users' Personal Data

Data collected through the QSTAR Portal will be treated as secret and confidential.

The personal data collected will be subject to automated processing and included in the corresponding automated processing activity files owned by QSTAR and for which QSTAR is responsible.

QSTAR will provide Users with suitable technical resources so that, prior to delivery of personal data, they may access the notice on the Personal Data Protection Policy as well as any other relevant information, and may provide their consent so that QSTAR may proceed with the automated processing of its Users' personal data. The User's acceptance of the processing of personal data is always revocable, without retroactive effects.
 
Finality of the collection and automated processing of Personal Data

QSTAR, responsible for data processing, informs that the automated collection and processing of personal data requested is used for purposes of management, administration, provision, expansion and improvement of the services offered by QSTAR in its Portal at any time, and all of the foregoing based on the contractual relationship between the User and QSTAR or the User's consent. Likewise, based on legitimate interests, its purpose is the quantitative and qualitative study of visits and of the use of services by Users, the design of new services related to QSTAR own services and their updates, and the remission by traditional and electronic means of technical and operational information and any other information related with specific parameters selected by the User in the Registration Form, surveys or commercial or advertising information on the products and services offered by QSTAR or third-party Collaborators.

Users are not required to receive the aforementioned advertising or surveys, and may mark this option in the means provided for this purpose by QSTAR in the Registration Form with regards to the offered services, through a written communication or directly through the pre-notice procedure in each commercial communication.

QSTAR, as a result of the existence of a previous contractual relationship and based on legitimate interests, may send commercial communications on its own products and services similar to those which were initially object of a contract with the User, without requiring the User's authorisation or express request. Nevertheless, the User, in any case, will have the aforementioned means available to express his or her opposition to receiving this type of commercial communications.

In no case will QSTAR use its Users' personal data for purposes other than those mentioned above.

The User declares that all of his or data provided are true and correct and is obligated to communicate to QSTAR any changes in relation to the same. The User is entitled to oppose the processing of any of his or her data that is not absolutely necessary for formalizing the contract and the use of the same for any other purposes different from the maintenance of his or her contractual relationship.

Likewise, the User guarantees being over the age of 14 and having sufficient legal capacity to enter into obligations with regards to the services offered by QSTAR, in accordance with applicable regulations.

Personal data of third parties provided by the User to QSTAR

In the event that the User provides personal data of third parties, QSTAR will not be held liable for compliance with the principles of information and consent, wherefore the User must guarantee QSTAR of having previously informed and obtained the express consent of the owner of that data to notify QSTAR of the same. To this end, the User must inform the third party of this Privacy Policy and obtain express consent for the processing of the third-party data by QSTAR. The User will release QSTAR of any liability in relation to any non-compliance in which it may incur in this regard. 
 
Transfer of personal data of Users to third parties

The transfer of personal data of Users to third parties will not take place without prior consent granted by the Users. In this case, QSTAR will expressly inform the User of the transfer of his or her personal data to third parties, identifying the transferees of said data and the purpose of the transfer of that personal data.

Notwithstanding the preceding paragraph, the User grants permission for the use of his or her personal data when this is required by Public Administrations, the State Fiscal Authority, Courts and competent administrative Authorities or by judicial sentence; likewise, in general, to physical or legal persons to which the communication of said data is necessary for the correct and improved customer service, or by legal imperative.

The User's acceptance of the transfer of personal data is always revocable, without retroactive effects.
 
Retention period of personal data 

Users' data will be retained for the minimum time period necessary to correctly render the service offered as well as to respond to any liabilities which may derive of the same and with regards to any other legal requirement.

In the case of the use of Users' data to receive commercial communications from QSTAR, Users' data will be retained until the User declares the wish to no longer receive said communications, whether through the means offered in the communications themselves or through one of the ways explained below.

Users' Rights in relation to their personal data

Users are entitled to exert their rights to access, rectify, suppress, oppose, limit and in relation to the portability of their data, for which Users must send a letter or email, attaching a copy of their National Identity Card (DNI) or equivalent documentation for identification purposes, to the following address:

Security and updates of Users' personal data

QSTAR has adopted the legally required levels of protection of personal data, and has installed all of the technical means and measures within its reach to avoid the loss, misuse, alteration, unauthorised access or theft of personal data provided, in line with technical state-of-the-art and in compliance with legislation in effect. Despite this, the User must be aware that security measures used in the Internet are not impregnable. 

For purposes of keeping Users' personal data updated, it is important for Users to notify QSTAR whenever any change occurs in the same.

Data Protection Officer

The QSTAR DPO (Data Protection Officer) is in charge, within QSTAR, of compliance with regulations on personal data.

Cancellation of the commercial communications service

Users are entitled to revoke, at any time, the consent given to receive commercial notifications, by notifying QSTAR of the wish to no longer receive these. For this, the User may either revoke his or her consent via the means described in the preceding section on Users' rights in relation to personal data, or click on the link included in each commercial communication, thereby cancelling the sending of electronic commercial communications.

(SPANISH) POLÍTICA DE PRIVACIDAD 

​De acuerdo con lo establecido en la Ley Orgánica 15/1999, de Protección de Datos de Carácter Personal (en adelante, LOPD), así como en su Reglamento de Desarrollo, aprobado por Real Decreto 1720/2007, de 21 de diciembre (en adelante, RLOPD) y en el Reglamento 2016/679 del Parlamento Europeo y del Consejo de 27 de abril de 2016 relativo a la protección de las personas físicas en lo que respecta al tratamiento de datos personales y a la libre circulación de estos datos (en lo sucesivo, RGPD), QSTAR SLU. (QSTAR) informa a los usuarios de su Política de Protección de Datos, para que estos determinen libre y voluntariamente si desean facilitar los datos personales que se le puedan requerir con ocasión de la suscripción o alta en algunos de los Servicios ofrecidos. Salvo en los campos en que se indique lo contrario, las respuestas a las preguntas sobre datos personales son voluntarias.


QSTAR se reserva el derecho a modificar la presente política para adaptarla a novedades o exigencias legislativas y jurisprudenciales así como a prácticas de la industria, teniendo en todo momento en cuenta los legítimos intereses del consumidor o usuario. Ciertos servicios prestados en el Portal pueden contener condiciones particulares con previsiones específicas en materia de protección de datos personales.
 
Confidencialidad en el tratamiento automatizado de los datos de carácter personal de los Usuarios

Los datos personales recogidos a través del Portal por QSTAR serán tratados de forma secreta y confidencial.

Los datos personales recogidos serán objeto de tratamiento automatizado e incorporados a los correspondientes registros de actividades de tratamiento automatizados titularidad y responsabilidad de QSTAR.

QSTAR proporcionará a los Usuarios los recursos técnicos adecuados para que, con carácter previo a la entrega de los datos personales, puedan acceder a este aviso sobre la Política de Protección de Datos de Carácter Personal o a cualquier otra información relevante, y puedan prestar su consentimiento a fin de que QSTAR proceda al tratamiento automatizado de los datos personales de los Usuarios. La aceptación del Usuario para que sus datos puedan ser tratados tiene siempre carácter revocable, sin efectos retroactivos.
 
Finalidad de la recogida y tratamiento automatizado de los datos de carácter personal

QSTAR como responsable del tratamiento le informa que la recogida y tratamiento automatizado de los datos de carácter personal solicitados tiene como finalidad la gestión, administración, prestación, ampliación y mejora de los servicios ofrecidos por QSTAR en el Portal en cada momento, todo lo anterior basado en la relación contractual que mantenga con QSTAR o su consentimiento. Asimismo, basado en el interés legitimo, tiene como finalidad el estudio cuantitativo y cualitativo de las visitas y de la utilización de los servicios por parte de los Usuarios, el diseño de nuevos servicios relacionados con los servicios propios de QSTAR y sus actualizaciones, y el envío por medios tradicionales y electrónicos de información técnica, operativa, aquella relacionada con los parámetros concretos seleccionados por el Usuario en el Formulario de Suscripción, formularios de encuestas o información comercial o publicitaria acerca de los productos y servicios ofrecidos por QSTAR o por terceros Colaboradores.

El Usuario no queda obligado a recibir la mencionada publicidad ni los formularios de encuestas, señalándolo así, a través de las vías dispuestas al efecto por QSTAR en el Formulario de Suscripción a los servicios ofrecidos, mediante comunicación por escrito o directamente a través del procedimiento previsto en cada una de las comunicaciones comerciales.

QSTAR, como consecuencia de la existencia de una relación contractual previa y basado en el interés legitimo, podrá enviar comunicaciones comerciales, referentes a productos o servicios propios similares a los que inicialmente fueron objeto de contratación con el Usuario, sin necesidad de contar con su autorización o solicitud expresa. No obstante, el Usuario, en todo caso, dispondrá de los medios arriba dispuestos para mostrar su oposición a la recepción de este tipo de comunicaciones comerciales.

En ningún caso QSTAR utilizará los datos personales de los Usuarios para fines distintos de los anteriormente mencionados.

El Usuario manifiesta que todos los datos facilitados por él son ciertos y correctos, y se compromete a comunicar a QSTAR los cambios que se produzcan en los mismos. El Usuario tiene derecho a oponerse al tratamiento de cualquiera de sus datos que no sean imprescindibles para la celebración del contrato y a su utilización para cualquier finalidad distinta del mantenimiento de su relación contractual.

Asimismo, el Usuario garantiza ser mayor de 14 años y tener reconocida la suficiente capacidad jurídica y de obrar como para contratar los servicios ofrecidos por  QSTAR, de acuerdo con las normas aplicables.

Datos personales de terceros suministrados por el Usuario a QSTAR

En el caso de que el Usuario facilite datos personales de terceros, QSTAR no puede responsabilizarse del cumplimiento de los principios de información y consentimiento, por lo que deberá ser el Usuario quien garantice a QSTAR haber informado previamente y obtenido el consentimiento expreso del titular de los mismos para comunicar sus datos a QSTAR, Para ello, deberá informarles de la presente política de privacidad y obtener el consentimiento expreso para el tratamiento de sus datos por parte de QSTAR, El Usuario responderá frente a QSTAR y mantendrá indemne a QSTAR de cualquier incumplimiento en que se pudiera incurrir por este hecho. 
 
Cesión de datos personales de los Usuarios a terceros

La cesión de los datos personales de los Usuarios a terceros no se realizará sin el previo consentimiento de los Usuarios. En tal caso, QSTAR informará expresamente al Usuario sobre la cesión de sus datos de carácter personal a terceros, indicando la identidad de los cesionarios y la finalidad de la cesión de los datos de carácter personal.

No obstante lo señalado en el párrafo anterior, el Usuario consiente que se utilizará la información de sus datos personales cuando así sea requerido por las Administraciones Públicas, Agencia Tributaria, Tribunales y Autoridades administrativas competentes o por mandato judicial; así como también, en general, a las personas físicas o jurídicas a las que sea necesario comunicar los mencionados datos para la correcta y mejor atención del cliente o por obligación legal.

La aceptación del Usuario para que sus datos puedan ser cedidos tiene siempre carácter revocable, sin efectos retroactivos.
 
Tiempo de conservación de los datos personales 

Sus datos, serán conservados el tiempo mínimo necesario para la correcta prestación del servicio ofrecido así como para atender las responsabilidades que se pudieran derivar del mismo y de cualquier otra exigencia legal.

En el caso de uso de sus datos para recibir comunicaciones comerciales de QSTAR, sus datos serán mantenidos hasta que manifieste su voluntad de dejar de recibir dichas comunicaciones, ya sea por el medio ofrecido en la propia comunicación o a través de una de las formas que se recogen en el siguiente punto.

Derechos de los Usuarios en relación a sus datos personales

Los Usuarios tienen reconocidos, y podrán ejercitar los derechos de acceso, rectificación, supresión, oposición, limitación y portabilidad de sus datos para lo cual deberán enviar una carta o correo electrónico, adjuntando copia de su DNI u otro documento de identificación equivalente, a la siguiente dirección:

Seguridad y actualización de sus datos personales

QSTAR ha adoptado los niveles de seguridad de protección de los datos personales legalmente requeridos, y ha instalado todos los medios y medidas técnicas a su alcance para evitar la pérdida, mal uso, alteración, acceso no autorizado y robo de los datos personales facilitados en atención al estado de la técnica conforme a la legalidad vigente. A pesar de ello, el Usuario debe ser consciente de que las medidas de seguridad en Internet no son inexpugnables. 

Es importante que, para que podamos mantener sus datos personales actualizados, nos informe siempre que se produzca una modificación de los mismos.

Delegado de Protección de Datos

El Delegado de Protección de Datos de QSTAR, conocido popularmente como DPO (en inglés, Data Protection Officer), será el garante dentro de QSTAR del cumplimiento de la normativa de la protección de datos.

Baja en el servicio del envío de comunicaciones comerciales

El Usuario tiene derecho a revocar en cualquier momento el consentimiento prestado para el envío de comunicaciones comerciales notificando a QSTAR que no desea seguir recibiendo las mismas. Para ello, el Usuario podrá o bien revocar su consentimiento en la forma descrita en el apartado anterior relativo a los derechos de los usuarios en relación a sus datos personales o bien pinchar en el enlace incluido en cada comunicación comercial cancelando por tanto, el envío de comunicaciones comerciales electrónicas.
